Grant of Probate

What does it mean?

A grant of probate confirms the authority of the executor to administer the estate of the deceased person. In most cases a grant of probate is required to deal with the deceased’s person’s assets i.e. to enable sale of the property or withdrawal of sole bank accounts.

You may not need a grant of probate if the deceased owned all of their assets jointly with another person as ownership of the joint assets will be transferred automatically to the survivor. If a person’s estate does not consist of property and their cash assets are not considerable then you may not need a grant of probate. Whether a Grant of Probate is required depends entirely on the circumstances of the individuals estate. 

TFS can act for you in two ways: 

Grant only basis - 

  • Obtain the relevant documents required to make the application
  • Complete the Probate Application and the relevant HMRC forms
  • Draft a legal statement for you to swear
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate and securely send the appropriate number of copies to you.

Full administration basis - 

  • Write to each institution with which the deceased held an account to obtain date of death values
  • Obtain property valuation (if relevant)
  • Obtain the relevant documents required to make the application
  • Complete the Probate Application and the relevant HMRC forms
  • Draft a legal statement for you to swear
  • Make the application to the Probate Court on your behalf
  • Obtain the Probate
  • Transfer/sell/cash in each asset in accordance with your instructions
  • Produce full estate accounts
  • Distribute the deceased’s estate in accordance with the will

The professional fees we charge will vary based on the following factors:

  • Value of the Estate
  • Experience of the Fee earner
  • Complexity
  • Number of beneficiaries
  • Whether a property is involved (Sale or transfer of a property is not included)
  • Multiple bank accounts

Disbursements are costs related to your matter that are payable to third parties, such as court fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.
