What is Domestic Abuse?

Domestic abuse isn’t just physical. It can be emotional, financial, sexual or psychological - and it’s never your fault. Abuse is about control and power, and the law now recognises this. Since 2015, coercive and controlling behaviour has been a criminal offence in England and Wales, and there are protective steps you can take.

How We Can Help

Our expert family lawyers can help you apply for protective court orders, sometimes within the same day. If needed, we can act without the other party being notified in advance to keep you and your children safe.

Some survivors may qualify for legal aid for domestic violence cases. We do not offer legal aid but click here on how to access financial support.

The two main types of injunctions are: 

  • Non-Molestation Order

This order stops someone from using or threatening violence, pestering, or contacting you in any way. It also prevents them from asking others to do the same. It’s especially effective in cases involving repeated messages, phone calls, or stalking behaviour. A non-molestation order carries automatic power of arrest if breached.

  • Occupation Order

This can remove someone from your home or prevent them from entering the property and surrounding area. It’s used in more serious cases where the court agrees that, for everyone’s safety, it’s better if one person is excluded from the home.

Urgent Legal Support When You Need it Most

As soon as you get in touch with us, we’ll act quickly. In urgent cases, we can apply to the court within 24 hours for a protective order - sometimes even on the same day.

A non-molestation order prevents someone from threatening, harassing or contacting you. An occupation order can remove them from your home and keep them away from a defined area.

Legal aid is available for some survivors of domestic abuse. While Thomas Flavell & Sons do not offer legal aid, we’ll advise you where you might be able to access support elsewhere if needed.

In urgent cases, we can apply to the court on your behalf within 24 hours - and sometimes even faster. 

Orders typically last for six to twelve months but can be extended if necessary. We'll review your case regularly and guide you every step of the way.
