This week is Resolution’s “Good Divorce Week”

Resolution is a community of family justice professionals who work with individuals who are going through a separation or divorce, supporting them in a way that strives to avoid unnecessary conflict. 

This year members are celebrating “The Resolution Code” which is a reminder of Resolution’s ethos which is intended to ensure that the legal matters arising from the separation are dealt with respectfully and constructively, with the aim to support individuals in achieving positive outcomes, be it a foundation for co-parenting their children or their post separation financial stability.

What is a “Good Divorce”?

For most people, if there is such a thing, would probably be managing to separate amicably and achieving fairness between them as quickly and cost effectively as possible. 

Whilst every effort is made to avoid Court proceedings, and Non-Court Dispute Resolution options such as mediation, Collaborative Divorce are encouraged, wherever possible, the Divorce Application necessitates an online application to the Court

The no fault divorce regime has simplified the Divorce process, and it’s possible for people to manage the Divorce application themselves, without the help of a solicitor, however, it’s vital to ensure that financial affairs following separation are also formalised properly. It’s feasible to conclude a divorce without formal financial orders and without seeking legal advice, however, for these individuals, unbeknown to them, there could be future issues that raise their head long after the divorce.

At Thomas Flavell & Sons our family team are passionate about ensuring that our clients know of their options from the outset so that they can make informed decisions before or during their divorce.  In our view, this is one of the foundations for makes a “Good Divorce”. We are therefore launching a new Free Divorce Procedure service* which will support couples going through an uncontested straight-forward divorce. 

What’s included in our free Divorce Procedure service?

  • An initial options consultation for us to understand your circumstances.
  • Preparing your “Sole Applicant” Divorce application and submitting it on the Court’s online portal.
  • Keeping you appraised throughout the stages of the uncontested Divorce/ Dissolution procedure.
  • Making the applications for the Conditional Order and Final Order when appropriate for you and notifying you when the orders are made.

What isn’t included in our free Divorce Procedure service?

  • The Court fee of £612 which is payable to the Court when the Divorce application is initially submitted.
  • Any work associated with any additional application to the Court, associated with the Divorce, for example deemed service, personal service or similar.
  • Advice regarding the negotiation of a financial settlement, other than any preliminary discussion at your initial options consultation.
  • Advice regarding any court proceedings relating to resolution of financial matters arising from the separation, or formalising an agreed financial settlement.
  • Advice concerning the negotiation of child arrangements for children of the family or associated court proceedings.
  • Obtaining your marriage certificate and any translation of it.
  • Existing divorce proceedings.
  • Divorces involving another jurisdiction (the divorce laws relating to other countries).

The Thomas Flavell & Sons Free Divorce Procedure Service is available if you are ending a marriage or civil partnership in England or Wales, and it is straightforward and uncontested. 

Thomas Flavell & Sons Ltd (TFS) reserves the right to withdraw this service at any time. TFS will only agree to offer the free service following an initial discussion to understand the circumstances of the client. If circumstances change during the matter, TFS will discuss with the client and put costs in place for further work if required.
